Yeiner Perez, BART's Naked Acrobat, Released From Jail

Update 2:13 p.m.: We've just learned that Yeiner Perez will not be taking BART home tonight. A friend is scheduled to pick him up at 5 p.m. Also, his stay-away order is still in effect for the 16th St. BART Station, but not for the whole system, according to Tamara Barak Aparton, spokeswoman for the Public Defender's Office.

Despite pleas from San Francisco prosecutors, a judge this morning went ahead and released Yeiner Perez, BART's infamous naked acrobat, from jail.

According to the Public Defender's Office, 24-year-old Perez was released on his own recognizance so he could get mental health services in Alameda County. He has already scheduled an intake appointment for next week.

Perez has been behind bars since early June after he was caught on video naked and assaulting BART passengers in between performing acrobatics, including aerials, the splits, and impressive handstands.

Perez was arrested and later charged with two felony counts of false imprisonment and four misdemeanor counts of battery on public transportation.

Perez, who, according to authorities, is in the United States illegally, had been a member of a local circus troupe dubbed ClownsnotBombs which later fired him after the video of his antics went viral.

His attorney, Paul Myslin, recently filed a motion for his release, saying the Department of Public Health refuses to approve funding that would allow Perez admission into San Francisco's Behavioral Health Court, which offers mental health care for defendants in certain criminal cases and helps them find housing and jobs. That's because when Perez was arrested, he told authorities he lived in Berkeley and the program is only available to San Francisco residents.

So now, he's free to go back to Alameda County and get the mental health treatment he needs. No word on whether he'll be taking BART back to the East Bay.

Keep in mind this guy is just visiting on a visa... he should have had that revoked immediately. Instead of spending tax dollars on keeping him locked up.

This is ridiculous and stupid !! The judge should have sentence him to san Quentin , cause indecent exposure is a felony . He got mental health problems he should be locked up in Atascadero .

But will he get the mental health services he needs? He was denied that in SF because he had no registered address here and was "couch surfing" in Berkeley. If he has another mental breakdown in public, the judge should have his/her house egged. He's not a dangerous criminal, no, but he ain't right in the head, either!

Perfect... he faces no serious ramifications for his actions and is just released to roam the streets with the rest of the crazies. This time we have video of this lunatic attacking people and it still isn't enough to penalize him. Why wasn't he deported? He is only here on a temporary visa and his actions certainly are not those of someone who should be given permission to stay in this country. He is taking the spot of another more deserving immigrant.

Can someone explain why there wasn't a concerted effort to subdue this asshole early on in this situation?  Oh yeah, Norcalians are pussies when it comes to taking care of assholes.  I love SF, lived there for years, and have more than once watched some douchebag cause havoc while several able-bodied adults stood by and clucked.  Take care of shit you jerks!

How long are we supposed to keep a naked, mentally-unstable dude locked up? He touched a few people with his hands - not his privacy. I'm sure he's already been to psych eval. If they think he's o.k., they are the professionals. We wasn't a raging murderer - he was a flailing naked guy.

No ICE hold? (He overstayed his visa and is out of status). Oh that's right San Francisco is a "sanctuary city". At the very least he should only have been released into some type of sober living environment has he obviously has a serious substance abuse problem.
