Ricardo Asturias, S.F. Man Convicted of Sexual Abuse, Gets 16 Years in Prison

A San Francisco judge has given 68-year-old Ricardo Asturias 16 years and 8 months in state prison for sexually abusing a 4-year-old female relative, as well as possessing child pornography.

In addition, the judge ordered Asturias to pay $625,000 in restitution for "non-economic damages," marking the first time in San Francisco where non-economic damages were awarded since the 1996 when the penal code was altered to allow restitution awards in felony child-molestation cases. Non-economic damages are defined as pain and suffering, emotional distress, and injury to reputation and humiliation.

"While this unprecedented sentence does not take away the years of abuse the victim endured, we hope it sends a powerful message that San Francisco will punish those who abuse vulnerable children." said District Attorney George Gascón.

From Jan. 1, 2008, through Oct. 8, 2010, Asturias, who was a relative of the family, sexually abused the victim repeatedly. At the time the sexual abuse began, the victim was 4 years old. On October 2, 2010, the victim informed her mother of the repeated sexual abuse, according to court testimony.

The girl's mother reported the incidents to the cops, and on Oct. 19, 2010, through a search warrant, the SFPD obtained Asturias' computers. On the computers, police found 934 images of child pornography on the Internet cache. During the trial, the victim testified against Asturias. In addition, two of Asturias' children testified, detailing sexual abuse they endured from Asturias more than 30 years ago, according to prosecutors.

On Oct. 23, a San Francisco jury found Asturias guilty of one felony count of continuous sexual abuse of a minor, and one felony count of possessing child pornography. He was sentenced on Dec. 17. Upon release, he will be required to register as a sex offender for the rest of his life.
