Hyatt Hotels Illegally Enrolled in E-Verify to Track Undocumented Workers, Labor Agency Claims

San Francisco's Hyatt Hotels and the labor unions are once again bickering about best practices. Back in July, if you'll remember, hotel workers picketed outside the Grand Hyatt Union Square, protesting difficult working conditions and calling for a boycott of the chain.

This time, the dispute is over Hyatt's use of the politically charged E-Verify program, which allows employers to electronically check new hires' Social Security numbers, to help determine their immigration status. Both the Grand Hyatt in Union Square and the Hyatt Regency along the Embarcadero implemented the system.

The National Labor Relations Board, though, claims that Hyatt had no legal grounds to implement the program without first negotiating this change with the workers' union. As a result, the government agency has ordered Hyatt to end its enrollment in E-Verify, which is run through the Department of Homeland Security.

E-Verify has grown popular among those seeking to make life in America less appealing for undocumented immigrants. Throughout the GOP primary debate season, candidates lauded E-Verify -- Republican presidential nominee Mitt Romney has promised to establish a national E-Verify system if elected. The program is tied to the larger concept of "self-deportation," which is pretty much a euphemism for "make life in America so shitty for undocumented immigrants that they'll rather return to their third-world homeland than stay here."

Four states -- Arizona, Mississippi, Alabama, and South Carolina -- have passed laws mandating that all employers use E-Verify. Fourteen others have required the program for government agencies, state contractors, or both.

California is one of two states to pass laws limiting the use of E-Verify -- last October, the state legislature passed a bill prohibiting state municipalities from requiring the program. Illinois went even further, barring all state companies from enrolling in the program "until the Social Security Administration and Department of Homeland Security databases are able to make a determination on 99 percent of the tentative nonconfirmation notices issued to employers within three days."

The two San Francisco Hyatt branches informed workers in April that the hotel chain had enrolled in the program. Since then, the NLRB filed a complaint against Hyatt, which will have a chance to defend its decision at a hearing scheduled for late October.

For months now, labor groups have accused Hyatt of overworking employees, unfairly firing workers, and turning on heat lamps on protesters in the middle of summer. A bevy of union and advocacy groups, including the NFL Player's Association, have endorsed the boycott.

None of these immigration laws are going to matter, if Obama returns for a second term? The only people it’s going to financially affect the taxpayers and the hundreds of billions of dollars to be extracted forcibly from their taxes. President Obama is sure to enact another blanket amnesty as Reagan did in 1986. Only chance to stave-off any of immigration policies is to vote as many TEA Party legislators into Congress as possible. God help us from the two corrupt political parties if we do not? Better also be alert for Democratic Voter fraud now until November, because ACORN is NOT dead.

 

The TEA PARTY (THE PEOPLE’S) PARTY should not be defined as just white people; they are not, they are millions of Americans of every nationality and skin color. My chapter has Hispanics, Black people, Asians from every walk of life.  We are “The People “frustrated with the corruption in both parties.  The Liberal oriented mainstream media have constantly lied about the agenda of the TEA PARTY. The TEA PARTY are moderate Constitutionalists, not the hard core Marxist-Communist-Socialists entrenched amongst the Democrats who want open borders and no laws to stop illegal migrants and immigrants from thrashing the U.S. taxpayers safety net.

 

If you want higher taxes; higher gas prices at the pump; an archaic tax system that benefits the privileged in both parties; a ever growing federal government with rules and regulations that inhibit new business creation; and a president that is giving even more to the “freeloader” parasites that cohabit with the illegal alien invaders who are draining the state reservoirs of money.

 

 I am sure about is the plan of the TEA PARTY if they can eject many Democrats and Republican incumbents and replace them? It’s already happening and by replacing incumbents in the Republican Party can politically persist that the “LEGAL WORKFORCE ACT (E-VERIFY) and the BIRTHRIGHT CITIZENSHIP LAW” finds passage and enacted to restrain more illegal alien invaders. They bring their unborn babies here, to live as parasites of the U.S. taxpayer. The children of illegal aliens had no say in coming to America, but by the enactment of the BIRTHRIGHT CITIZENSHIP BILL, this incredulous expensive issue for taxpayers is solved.

Where has all the common sense gone in this country! The real question to every employer should be "Why wouldn't you use e-verify for every single hire to protect all workers and jobs?"

I am a current Govt union employee and I find it offensive when people start attacking union employees.  However, I have to say that it is outrageous that any union would be supporting non citizens who came here illegally,  who should be deported and who have no honesty, integrity or respect for the laws of this country or the rights of it's citizens.  Many of them use false Social Security numbers which is most likely why the Hyatt decided to check legal status.  Companies can be fined up to $100,000 per day by IRS for knowingly allowing people with false SS numbers to work there.  There was a packing CO that got fined and when they did, they had to let go 25% of their work force who had false SS numbers.  On the up side, those jobs were replaced quickly by unemployed Americans, so the defense that these jobs are the ones Americans don't want is bull.  Of course the illegal idiots were angry and threatened them, etc.   Even the State Govts, give work permits to non Americans while homeless Americans who are not messed up by drugs, etc could use those jobs.

 

My advice to non working Americans, would be to form a class action lawsuit and sue all unions and all companies and State Govts who knowingly hire non Citizens, either on work permits or illegally without first checking to see if there are Americans who could do the jobs.  In particular, I think the distressed Citizens from areas such as the Detroit area should come to CA, apply for jobs, keep records and file lawsuits on those companies who hired illegals over them for jobs that they can do and any union that supports it.  Unions have money.  It's sad but the democratic party is being run by the hispanic caucus, who are not just representing hispanic Americans, but non citizens as well.  Since when should non citizen groups get represented in our Government?  If we don't stop this crap, we will not even be a country, but a free for all.

There was a time when the labor movement was illegal. The labor movement in the US was built in large part by immigrants, many of them undocumented. The bosses game is divide and conquer. The key to winning justice in the workplace is solidarity. The labor movement, and all working people, should follow the lead of UNITE HERE in fighting for dignity and respect for all people.

THE LAST RESORT?  THE TEA PARTY OF AND FOR THE PEOPLE.

President Obama should he win the election has promised that he would force passage of another Comprehensive Immigration policy.  This would then substantiate that both parties would never fully enforce immigration laws, whether going against the U.S. constitution by presidential authority as we saw with passage of the Dream Act. Since the 1986 Simpson/Mazzoli bill signed into law, everything has been compromised by a failure to fully fund the policies. This has been proven by systematic failure to make illegal entry a felony, the fact the real double layer fence doesn’t exist, that the instigators of Sanctuary city ordinances are not punished by ICE and that the Birth instant baby citizenship law hasn’t been amended in the name of saving taxpayers over $100 billion dollars annually. 

 

America has giant magnetism to people who are drawn here for public programs, that Obama czars have compromised welfare essentially drafted for citizens and lawful immigrants. These illegal entries that skirt our laws know more about our benefit laws than a good many U.S. citizens? This has especially drained the treasury of states run mainly by liberal-Marxist assemblies as California, Nevada, and New York with bloated populations of illegal aliens. Over past decades our nation has been under assault by the poverty of other countries, bringing their unborn babies here to take advantage of a passionate country that in this present climate can no longer afford to feed the world, or offer uncompensated health care. Even more significant is the onslaught of parents and children that lawfully enter our country through Chain Migration.

 

These hundreds upon hundreds of billions of dollars should be spent on the legal population, not in harboring foreign nations that continually challenge our laws and succeed with Liberal interpretation of our laws in the courts. Neither Obama nor Romney will enforce immigration laws, but the thorough saturation of TEA PARTY legislators into the Republican Party will have great influence and empowerment to propel the Senate and House into fighting against the Socialistic conspiracy or the GOP elitists who want to keep things as they are?

 

Here are a few of the issues that can be altered by the TEA PARTY LEADERSHIP:

 

1. The TEA PARTY can force a vote on the ‘Legal Workforce Act’ (E-Verify) and enact it as mandatory in every business nationwide. Those who feel they are not accountable will be looking at hefty fines, loss of assets and even prison. All those who ignore the I-9 audits in not implementing the computer to detect illegal aliens in the workplace will be sanctioned?

 

2. The TEA PARTY will force a vote on the ‘Birthright Citizenship Act’ concluding once and for all, that pregnant women can no longer gain citizenship through a misguided loophole for a child, just by slipping past Customs and Immigration Enforcement (ICE) at the border or over staying a visa, leading ultimately to yet another ‘Blanket Amnesty’. What about American teenagers, who have been pushed out of jobs that were the monopoly for our kids a couple of decades back?

 

Both major political parties wants a true end to illegal immigration, but the millions of citizens and residents in the TEA PARTY will insure that citizens and lawful immigrants always get first priority—not pandering to foreign nationals. Incidentally—readers should go to teaparty.org and then judge for yourself, if Obama is Liberal friends in the press are concealing the truth?

 

ATTN: The TEA PARTY will be safeguarding the nationwide election procedure, watching for non-citizens voting in November. As for Sheriff Joe, if the election for him is not derailed by “Voter Fraud” he will certainly win?

SEIU member here. Despite the newest crop of communists in the union leadership, most union members don't go for illegal alien coddling. SEIU every so often tried to get the rank and file to create work taskforces at union meetings to support illegal alienship. E-Verify just like Voter ID will shake up the communists every time.

If your illegal and if you cannot pass E Verify then you need not apply for a job, the best part is the Fraud in the WH cannot pass E verify and has no credentials to verify his own job.  The unions show no class in this matter they are wanting dues and membership growth,. the dues go to politicians who could care less where it comes from even if the sell you out.

I was a local union president. My father was a chief steward with the United Auto Workers. My grandparents came to this country in 1917- LEGALLY.  This is total nonsense and disrespects the labor movement and those who followed the rules to come to this country.

As a lifelong, dues paying, union member and supporter, coming from an entire FAMILY of union members, leaders, organizers and supporters,  I totally RESENT any union in this nation supporting illegal aliens.  They put Americans out of work, or at best depress our wages, not to mention all the other laws they break and crimes they commit against American citizens.  The ONLY reason the union objects to the use of E-verify in this or ANY situation is to line their own pockets.  Unions, unfortunately, have become as corrupt as any other big business.  It's all about lining YOUR pockets.  Shame on you! It was AMERICANS who built those unions...ALL OF THEM! NOT illegal aliens.

This makes no sense. Why would the employee union be opposed to the use of E-Verify? Illegal immigration is one of the easiest ways that corporations can depress wages - aren't labor unions supposed to be against that sort of thing? We've entered into some kind of bizarro world where the employees' union somehow doesn't want a higher wage for its members...

 @nortonsf WE Americans have made great strides in the labor vs management movement. But do we really want our children growing up without access to real work experience, because illegals take the high-schooler jobs away as permanent employees? What about those times when fathers are in-between jobs, he no longer has any options of work because all jobs are filled to capacity and there is a waiting list of Americans who need work. Suppose it was your job at stake, like in Silicon Valley where my friends have been outsourced in America by recent immigrant labor. Those jobs are part of our tax revenue problem in CA as well because they pay much less than if an American held the job. Finally, why do you care about people whom we could dignify and respect if they would come legally instead of blindsiding our infrastructure, and citizenry.

@justenglish20 - in 1986 immigration reform was passed but really only ended up being an amnesty because to get it to pass all of the enforcement provisions were stripped out.
