Ron Paul Won't Legalize Marijuana -- Because He Can't

As if the promise to dismantle most of the Washington-based government wasn't enough, Texas Congressman Ron Paul has also made waves in his bid for the Republican presidential nomination with his maverick stance on drug policy.

During his 30 years in the House of Representatives, Paul has authored and co-authored multiple marijuana-friendly bills. He's proposed laws to decriminalize marijuana, permit industrial hemp farming, and constitutionally delegate to states how to enforce extant medical marijuana.

None of these bills have ever been heard in committee. Nonetheless, Paul's drug war bona fides are earning him admirers among liberals who note that Paul is the only candidate to remotely approach the two points necessary to end the Drug War: Repealing, or at least amending, the Controlled Substances Act, and a rescheduling of marijuana within the DEA's pantheon of forbidden fruits.

A growing number of marijuana activists are embracing Paul as a pot-friendly alternative to President Barack Obama, whose Justice Department has done more to dismantle state-legal medical marijuana than George W. Bush's crew ever did.

These supporters ignore a key point: If Paul were president, he wouldn't be any better for legalizing marijuana than President Obama -- or worse than Romney or Santorum. And as recently as Monday's debate in South Carolina, Paul had this to say about ending the Drug War: "I don't think we can do a whole lot about it."

Marijuana was criminalized by the feds in 1970, when the Controlled Substances Act was passed by Congress (under pressure from Richard M. Nixon's administration). Only Congress can repeal an act of Congress, just as only Congress can amend the Constitution, raise taxes, and wage war (legally).

The federally subsidized war on marijuana can end if the CSA remains, as long as marijuana is dropped from Schedule I, the list of the most dangerous drugs, to Schedule II (which includes cocaine) or lower. Through the CSA, the general public can directly petition the Attorney General to do this. Theoretically, the president could issue an executive order unilaterally urging the Attorney General to do this, but to do so would be "an extension of executive power," according to Robert Smith, a professor of political science at San Francisco State University.

Earlier this month, Stephen DeAngelo, the founder and CEO of Oakland's Harborside Health Center -- the nation's largest cannabis dispensary and the subject of the Discovery Channel documentary series Weed Wars -- made noise of his own when he suggested to the Huffington Post that pot activists should vote Republican. "We are single-issue voters," said DeAngelo, whose comments were followed by the Justice Department's extension into Colorado of the crackdown on state-legal medical cannabis that's been ongoing in California since September. Surely a Republican cannot be worse?

DeAngelo isn't supporting Paul or any other Republican, or at least not yet, he told us during a recent interview with SF Weekly. "Millions of us are looking for the right place to put our vote," DeAngelo said. While other marijuana activists like South Lake Tahoe-based Steve Kubby, author of one of the marijuana legalization voter initiatives vying for a spot on Californians' November 2012 ballots, have thrown their weight behind Paul, DeAngelo says he'd prefer to back Obama as he did in 2008. "I'm waiting and hoping that he does the right thing and comes to our defense," he said. "I'm not going to vote for someone who thinks I'm a criminal and should be in prison."

What most of gov't officials dont understand is alot of people just dont educate themselves and believe what ever they hear first from the government.There are radicals against marijuana saying how deadly it is and sending out false information to the masses. One of the common sayings is that people will abuse it. This statement is so ridiculous seeing as you can abuse anything, people abuse hamburgers, tobacco, and many other things daily which leads to constant death and diease in our society, yet marijuana has never killed anyone. why is it illegal if there are no reported deaths? and why are other things proven bad for us legal?

No, Ron Paul cannot do anything by himself, but mountains can be moved in days if enough people will act, and not just talk about it. Glen Beck rallied over a million people to the Lincoln Memorial a few months back. If that many people showed up in Washington to get congress to end the war on drugs, and legalize marijuana, then it would happen.  If by some chance it still did not happen very quickly, then vote them out of office, because their time is likely up in a few months.Washingtion is full of good people until they need money to get elected again, then they take money from pharmaceutical companies, or whoever needs theit vote, etc.,then vote for them and against what the public wants. (So change the law and allow each candidate only $1 million dollars to run on, and do away with Super-PACS). Wouldn't that actually make a presidential race interesting, make all candidates equal except for their minds.I don't like the way our country is headed, but unless people stand up, get off the couch and take our country back, then it will really be gone, and it's truly now or never. In the next 3 years, our government will control everything, and out freedoms will be gone forever, at least as we know it. In only 3 years, the government has taken over almost everything. Legalizing pot will not only save the federal government money on prision cost to state which is r money. But it will also make a new taxable income for the government that they can regulate through the same laws used for alcohol and tabacco. It will create a new export for us and also create jobs in clothing seasonings and other type things. It is natural. Ron Paul wants the power to go back to the States ( as the 10th Amendment declared ) and thus keep it decentralized. Allowing states to govern themselves is the only way to be truly ruled by the people and for the people. As of now, federal policies ride roughshod over state. I love how so many ever-so-"enlightened" supporters of "the ONLY candidate who would follow the Constitution -- and who's not the spawn of the devil himself!!" in the comments here are calling for Paul to bypass the Constitution and "stop the drug war". You hacks don't know the Constitution, nor are you its friends. You're just as bad as the kool-aid drinkers for ANY candidate - and there are those for ALL candidates, so don't think I'm unfairly attacking just Ron Paul.

That said... an intellectually honest person *has* to admit that the VOCAL Paul supporters are more likely to buy into some pretty insane and sometimes utterly bigoted stuff than other candidates' supporters. Even Paul has hinted at realizing this is the case, though he doesn't want to alienate his supporters so won't call them out... when confronted by 9/11 truthers who asked why he didn't more actively push their cause, he didn't attack their arguments but instead told them he couldn't take the political heat... which doesn't really back up the whole "man of principle" thing he's supposedly got going on. (Nor does putting earmarks into bills that are going to be passed, voting against them, and then hypocritically saying you're a champion for an end to earmarks while you effectively put earmarks into place without *technically* voting for them. Which is what he does. Man of principle, my rear end.)

It's no coincidence, though, that he attracts such crazies given the insane stuff he regularly spouts -- and we're not just talking ideological differences that can be dismissed as "let's be isolationists vs let's be the world's police force." He is a-okay with Iran getting nuclear weapons, says that's just "Israel's problem", and spouts a number of other clearly anti-Israel smears, lies, mischaracterizations, etc. He did a very similar thing to what I mentioned with the 9/11 truthers, where someone asked him to state if he's anti-Israel, and he essentially said yes but said he can't explicitly say such because it'd get him in trouble politically. Cannabis enriched foods are preventative measures to sickness even death. Decrminalizing and legalizing marijuana means a safer smoke on the shelves that cigarettes sit on and bars of alcohol should be blunt smoking cafe's ends irate people raged drivers and promotes a safer society for our future smart people smoke marijuana to slow down enough to consitrate on school and learning to adabt to this rediculously fast past rat race we live in. The President is authorized by the Constitution to direct his cabinet. So, a President Paul will simply direct the Attorney General to stand down on all enforcement of federal marijuana laws. Simple. Done. Nothing needed from Congress. After everyone sees that it works just fine then the Congress will follow the will of the people. Although the safest bet is to simply continue to elect presidents that will instruct the attorney general to cease and desist.

I like to keep in mind that Ron Paul is a liberal, currently trying to win the republican nomination. he can't just come out and say he's for legalization, because then a majority of republicans will write him off, and not even give him the time of day as a candidate. If he's going to do anything about legalization, first he has to get the republican nomination. So all the marijuana activists.. first lets make sure ron paul gets as many votes as possible in the primaries (i swear if romney wins.. -_- lol) and then once it's obama vs. paul for president, we can decide who the better marijuana advocate will be :)

Hi all --

I'm curious how a president who preaches a weak Washington government could use his limited executive powers to pardon offenders serving time in state prisons and county jails.

Seems like he had a key opportunity on a national stag eto say he'd pardon folks, pressure Congress to repeal or amend the CSA, say he'd use political capital to tell the DEA to reschedule -- and didn't. Color me yellow, I suppose.

Chriz, are you really so ignorant as you portray yourself in these comments?  The president has the power to pardon ANYONE.  That is an executive power that is not going away anytime soon.  With this power ALONE, he could end the drug war, as so many commenters have already explained. 

The DOJ is directly under the executive branch.  There is no way this will change anytime soon.  President Paul will simply order his Attorney General to stop prosecuting the drug war.

Finally, the chief nexecutive makes appointments to the DEA.  President Paul will at the least fire Leonhardt and install progressives, or more likely, disband the DEA altogether.  

His "key opportunity" will come later, don't you worry.

That's an incorrect statement that Ron Paul "wants to legalize drugs."  He wants to END the federal drug war (for a number of reasons) and turn the legalization to the states, where the Constitution says it belongs.  They can decide - not the federal government.

With Industrial Hemp being free from the same regulations applied to marijuana by the DEA (unbelievable)  because they can't tell the difference, which is laughable, you could produce Bio-mass Cellulose Ethanol which will release Americas dependence on fossil fuels eventually as well as all the other wonderful things it brings to the table.
