Get Ready, Facebook: Cameron and Tyler Winklevoss Will See Another Day in Court

The Winklevoss twins, of Facebook history fame, have just delivered what is essentially a giant "JK" to the social networking site.

Aaron Sorkin, we hope you're paying attention to this. By all accounts, Cameron and Tyler Winklevoss, the identical twins who say Mark Zuckerberg stole their idea while at Harvard, were ready to drop their legal battle against Facebook on Thursday and accept the $65 million settlement they were awarded in 2008.

In 2010, they began trying to undo the settlement, arguing that Facebook was dishonest about the value of the $45 million in shares they received -- now worth more than $200 million. They struck out in the United States Court of Appeals for the Ninth Circuit in May, and just yesterday, they said they would no longer pursue a U.S. Supreme Court hearing.

But quicker than you can hit "Like," the twins and fellow Harvard student Divya Narendra showed they have some fight in them yet. Yes, they are still abandoning their quest to have their day in the court of last resort, but rather than going home, watching The Social Network, and calling it a day, they're just moving their case to another court.

Starting at square one, they reportedly filed a new case in the U.S. District Court in Massachusetts, claiming that Facebook was wrong during the arbitration not to disclose instant messages exchanged between the twins and Zuckerberg during those fateful Harvard years.

It looks, smells, and tastes like the same lawsuit, but it's not. It's a different legal angle, even if both lawsuits argue that Facebook withheld information that might have led to a larger settlement.
