'Giants Baseball: Torture' Still Yours to Trademark

The other day, we asked a lawyer if Giants broadcaster Duane Kuiper's all-too-apt catchphrase, "Giants baseball: torture!" could be trademarked. His answer? You bet it can. And if you want to trademark it, swing away.

Staci Slaughter, the San Francisco Giants' vice president of communications, said Kuiper, a former second baseman and longtime radio and TV man, has no plans at present to trademark his phrase. Neither does the team, for that matter.

"A lot of times things the broadcasters say grow organically," Slaughter says. She's seen plenty of people walking around with signs or T-shirts reading "Grab some pine, meat" -- a signature phrase from Kuiper's broadcast partner Mike Krukow. Neither the broadcaster nor the team ever tried to cash in on that one.

Comcast spokesman Jay dela Cruz said his organization isn't looking to trademark the phrase either. But that doesn't mean no one's pushing it to make a buck. A quick-and-dirty online search revealed it is currently possible to purchase the following "Giants baseball: torture!" paraphernalia:

  • A coffin. Actually that's just a general San Francisco Giants coffin. But, still, a Giants coffin!
