The man arrested for yesterday's daylight Sunset District shooting that left Cuong Lu dead on the street is Bao Luu, a 39-year-old San Franciscan.

Police spokesman Sergeant Wilfred Williams said Luu -- apparently no relation to his alleged victim -- is "known" to the criminal justice system. He would not elaborate on Luu's criminal record, however, because he did not wish for anything to "leak out" and compromise an ongoing investigation.

Witnesses claim Luu shot Lu, 35, three times after the victim exited the Pho Huynh Hiep 2 restaurant yesterday afternoon on Irving Street between 19th and 20th Avenues. Police in the area almost immediately disarmed and subdued Bao Luu.

Cuong Lu was the city's ninth homicide of the year, and first since Tony Lewis was discovered shot dead in someone else's automobile in Bayview last week.
UPDATE, 4:05 p.m.: Assistant District Attorney and office spokesman Brian Buckelew said Bao Luu will be arraigned tomorrow on one count of murder with a firearm allegation. "Personally inflicting great bodily injury or death" with a firearm adds 25 years to life to Luu's potential maximum sentence; if found guilty Luu will be facing 50 years to life.

Luu has two prior felony convictions, Buckelew said.
