Superior Court Mandates Heaven To Immediately Close Its Doors To Sinners
Judge Charlotte Walter Woolard granted City Attorney Dennis Herrera's motion to immediately close Heaven Mini Theatre at 1054 Kearny Street, finding that Herrera's motion established "sufficient probability" that the city would win its cross complaint against the enterprise. Heaven filed suit against the city in 2008 for allegedly violating its constitutional rights by issuing it violations for illegally operating an adult business. The owners have also claimed they were victim of shakedowns by police officers.
The city attorney's office couldn't help but have a little fun in their statement released today:
"Today's ruling should send a message to other would-be operators of illegal businesses that even 'Heaven' is subject to temporal laws here in San Francisco," said Herrera in the statement. "It's regrettable that this business chose to expend so much effort to flout the law rather than to follow it, and that a preliminary injunction was necessary to shut it down." (Dennis, even Tom Ammiano has trouble pulling off puns -- and you are not Tom Ammiano!)
Woolard also found that Heaven didn't demonstrate it would suffer irreparable harm if the injunction were granted. It seems that, despite being shut down, if you have T&A, the customers will come.
