Remember Lee Kaplan?

Last August, as Israel and Lebanon got busy lobbing missiles at each other, we published a cover story about the over-enthusiastic local activist Lee Kaplan, the self-appointed champion of Israel who infiltrates conferences held by pro-Palestinian activists. Kaplan has kept up the crusade -- for example, he recently sued UC Berkeley sophomore Yaman Salahi, who started the blog Lee Kaplan Watch to raise questions about Kaplan's writings and tactics. Kaplan sued in small claims court for defamation, and according to Salahi's latest blog post, Kaplan just won.

A very bitter and frustrated Salahi reports that he has been ordered to pay $7,500 in damages. He complains at length about the vagaries of small claims court, where judges are not required to submit written opinions with their rulings.

It's a small triumph for Kaplan, who has maintained for the past year that the blog is libelous, and who contacted Berkeley's dean of students to complain. But Salahi writes that he's holding tight to the first amendment, and vows to keep the blog going. "I will not stop my work in this regard, and I hope that others will not be intimidated by this audacious effort to chill political speech," he writes.

Did Salahi call up Kaplan's bosses and libel him to that boss? I think I read that in a local rag in Berkeley. That is not freedom of speech, but criminal behavior. regardless, this is an Israel/Palastine thing. No winning sides.

Salahi started by purposely ducking service which he admitted to the second Judge after he lost the first hearing by default.

He successfully sued to have his case heard again, which he won.

He then had a trial on the merits of the case and again had a $7500 judgment levied against him.

He appealed, and was granted a second trial before a different judge. He lost again.

Now he is claiming this is an attack on his 1st amendment rights? The court did not order him to remove his blog. His first amendment rights were never challenged. It was his malicious actions, stalking behavior, damage to Mr. Kaplan's professional reputation, and interference in his employment including threats to Kaplan's future employer that merited the judgement.

Remember, in court it's not what is alleged, but what can be proved that counts. Kaplan proved Salahi's intentional interference in his business with malice.

Salahi had a lawyer from Jewish Voice for Peace representing him for free (one wonders what other kinds of uses JVP uses it's donations for). Claiming it wasn't a "real" court or that he wasn't allowed to present evidence is yet more historical revisionism on the part of Salahi.

He had his day in court five times. He had an attorney. He was not prevented from presenting evidence. His first amendment rights are still intact. He can go on criticizing Kaplan till the cows come home---but he ought to be cautious about committing libel, or attempting to ruin another persons reputation with threats and with outrageous claims.

Otherwise, he may yet get his wish to face Kaplan in a "real" court.

The documents are on the courthouse website and there was further evidence presented in court. Two Superior court judges heard this case, and Salahi was proven to have lied so many times is bis declarations that the court easily knew he was lying. The fact that Salahi has friends like this Tom Pessah to lie for him on the Internet does not change the facts of this case. He is doing it all again now on the internet as well.

As a practicing attorney I read the submissions to the court by the lawyers for Mr. Salahi.

The submissions and motion to dismiss from Mr. Salahi's lawyers numbered in the hundreds of pages and related largely to 1st Amendment issues but the allegations and evidence submitted by Lee Kaplan targeted 'defamation' and cited loss of earnings for damages and not public statements or writings of Mr. Salahi.

Lee Kaplan showed that Mr. Salahi contacted several of the employers of Lee Kaplan and made statements that were defamatory and false and also made threats to the employers.

Mr. Salahi was sued not on the basis of his Blog or other public writings but on his PRIVATE writings and communications (threats) to the employers of Lee Kaplan.

It is all in the court filings which are available over the internet.

The private communications of Mr. Slahi to the employers of Lee Kaplan are not defined as falling under under the laws of 'free speech' in the United States.

Mr. Salahi lost before the Superior Court of the state of California and a sitting justice of that Court, not just before the Small Claims Court. The case started in Small Claims Court, but Mr. Salahi appealed and had a full trial ('de novo hearing') before a Justice of the Superior Court with full trial transcripts available.

Let's try to stick with the facts.

It should be noted that Mr. Salahi's behavior has been execrable and his misstatements regarding the court proceedings and his allegations of 'free speech' implications are false and reprehensible.
